Depends on where you buy them from. Most retailers make sure the CDs are in good condition and guarantee the quality anyway. At Hastings, I and several of my coworkers are incredibly strict when it comes to taking CDs from sellers. As a result, a vast majority of the used CDs are in very good condition.
I just bought
Yoshimi Battles the Pink Robots by The Flaming Lips. And it was in near perfect condition

Dark Passion Play---Nightwish.
This album.....is insane. The first song alone is worth the purchase price of the album, the rest is just the best icing on an already amazing cake.
Yes, this album is THAT good.

I bought a real hard copy of The Black Key's 'Brothers.'
I would tell you it's amazing, but I haven't had a chance to listen to it yet. Why? Because I bought a hard copy. And I have no CD player. Or computer.
