I am currently steeped in a Media Law class for my Filmmaking degree. We haven't specifically covered emulation, so I don't know about that, but let me put it in a simple context:
You risk becoming the target of copyright lawyers, and if that doesn't happen, the legality doesn't matter. They will bring you to an inch of your life in the court system. They don't care about winning or losing. They care about making examples of people, and getting whatever penny they can. More than one documentary filmmaker, for example, has had instances of Fair Use in their films and still been brought to court. It may be perfectly clear that it's Fair Use, but they can absolutely maim you in the court system regardless. That's just the way it works.
Maybe this isn't the same thing, but honestly, I'm scared poopless after this class. I don't like the laws, but as it currently stands, the copyright lawyers hold an immense degree of power, and they don't really care who they use it against.

So maybe I shouldn't emulate after all?

I see. Too bad they don't have many emulators for Mac.
That way, I can emulate my PS2 games.
